Banned Drivers To Face Tougher Sentences For Road Deaths

There is also likely to be a new law implemented to sentence disqualified drivers who cause serious injury.

The law will apply to disqualified drivers who hold a full UK licence and theory test certificate and will also affect those banned from driving before even obtaining a theory test certificate or full licence.

Book Your Theory Test Online has learnt that under the new laws a disqualified motorist who causes death will be jailed for up to a decade. The present law sees offenders jailed for just two years. New legislation will see the crime carry a minimum four year sentence.

It’s understood that the Government is enforcing the changes in response to concerns raised by the families of those affected by the death of a loved one as a result of a disqualified motorist.

Chris Grayling, the Justice Secretary, also plans to carry out a thorough investigation of driving offences and penalties to make certain that people who put the lives of others at risk are severely punished. 

Punishment will extend to offences caused by uninsured or unlicensed motorists.

In a statement from Mr Grayling, he said: “I want to make our roads safer and ensure people who cause harm face tough penalties. Disqualified drivers should not be on our roads for good reason. Those who choose to defy a ban imposed by a court and go on to destroy innocent lives must face serious consequences for the terrible impact of their actions.”

He added: “We are sending a clear message that anyone who does will face much tougher punishment.”

However, the Labour Party raised concerns about prison overcrowding. Shadow Justice Secretary, Sadiq Khan, said: “I agree that those driving without insurance that cause a death should be duly punished. However, the Government also needs to assure the public that there is enough room in the prisons to deal with the extra demand.”

He added: “The current shortage of space and increased overcrowding on their watch has led to serious problems in our prisons.”

According to Ministry of Justice statistics, approximately 8,200 people were convicted of driving while disqualified in 2012. Of those convicted, 16 led to prosecution and there were 13 convictions for causing death by driving while disqualified, unlicensed or uninsured.
