Driving theory test cheat fined for trying to record theory exam

Reports of driving theory test cheats are becoming more prevalent. The latest driving theory test cheat was caught at the Coventry test centre trying to record his exam.

We know what you’re thinking. Why was this driving theory test cheat recording his exam? Well, he was trying to record his theory test in the hope that it would help him succeed on the test next time round. One can only assume he was not confident in his ability to pass on this particular occasion, so devised a plan B.

Unfortunately, Danny Smith was caught in the act, pleading guilty at Warwick Crown Court for his misdemeanour and confessing to carrying items for use in fraud. He was caught at Coventry theory test centre with a mobile phone and Bluetooth device on his person.

Smith (32), who lives in Leeds, Yorkshire, was hit with a £1,000 fine plus £200 costs and a £900 criminal courts charge, but avoided jail time. Sarah Allen of the prosecution team involved in the case said: “Smith made an online theory test booking for a light goods vehicle to be taken at the DVLA test centre in Coventry.”

Smith had opted to use the theory test ‘voiceover’ service to listen to the questions via headphones. The voiceover service is usually reserved for candidates with reading difficulties. Upon arriving for his theory test on 15 September 2015, Smith was asked to sign a document to indicate that he would not take any electronic devices into the test booth.

Miss Allen said: “While the defendant was taking the test he removed the headphones and was seen to have something in his ear which appeared to be a Bluetooth device. He was asked to come out of the booth and spoken to and asked to hand over the device, but he denied he had anything with him of that nature.”

The police were notified of Smith’s actions and following a search, after his arrest, officers discovered a Bluetooth earpiece in his underwear plus a mobile phone strapped to his thigh. The court heard that it was not the first time Smith had acted suspiciously in a theory test booth.

In November 2014, Smith had sat a theory test at the Leeds test centre where staff grew suspicious of his actions in the booth. However, no charge was brought against him on that occasion.

Defending Mr Smith, Justin Jarmola said: “This was not an attempt to cheat in the theory test, but someone attempting to utilise it later at home for revision purposes. Mr Smith cannot read, and would therefore find it difficult studying for the test in the normal way, so wanted to record the questions so he could go through them later in his own time.”

Case recorder, Adrian Redgrave QC, said: “It’s akin to getting hold of a copy of exam papers. But this was not an offence where he intended to profit by disseminating test papers. What he did was to equip himself with the questions so he could prepare himself the more fully the next time.”
