Failing the driving theory test can be immensely frustrating, but what if circumstances beyond your control were to blame? Is there a theory test appeals process? Yes there is! Here’s what you can do if you’re unhappy with any part of your theory test…
You will no doubt be nervous enough when taking the driving theory test, but what if forces beyond your control are at work to scupper your chances of passing. Computer glitches, fire alarms and more are just some of the things that can disrupt your theory test, causing you to lose your focus and ultimately, fail your exam.
If an incident occurs that you feel contributed to you failing your theory test, you can appeal. Here’s how…
You can complain to the DVSA by email phone or post and you will get a response within 10 days. To make an official complaint, you must include:
* The type of theory test you took (i.e. car, motorcycle, bus etc…)
* The date, time and the theory test centre at which your exam took place
* Details of what your complaint is
* What you want the outcome of your compliant to be

If you’re not happy with the outcome, you can escalate your complaint by contacting the DVSA’s Head of Corporate Reputation. You can expect a response with 10 working days.

If you’re still not satisfied with the response, you can escalate your complaint to the DVSA’s Chief Executive, Gareth Llewellyn.

If the DVSA’s Chief Executive doesn’t deal with your complaint to your liking, you can instruct the DVSA to refer your case to the Independent Complaints Assessor (ICA). The ICA is:
* Is an independent body, separate from the Department for Transport and the DVSA
* Not a civil servant
If your complaint is escalated to the ICA, they will assess whether your case has been handled appropriately at all levels by the DVSA and will determine whether the decision on your theory test appeal is reasonable.
If you decide to escalate your complaint to the ICA, there is no cost involved.
